Privacy Policy

Air Tutors, LLC and its affiliates (“Air Tutors,” “we,” “us,” or “our”) provide online tutoring and related services for K–12 students through (1) school- or district-sponsored programs (“School Services”) and (2) direct-to-family services (“Direct Services”). This Privacy Policy explains how we collect, use, disclose, and protect information when you visit our websites, use our applications, access our tutoring platform, or otherwise interact with us (collectively, the “Services”). 

For information about how we collect, use disclose, and protect the personal data of under 13 users of Air Tutors, and individuals enrolled at a primary, secondary, or other educational institution (the “School Partner”) who use our products offered in a K-12 education setting with School Partners (“School Services”) please see our Children’s Privacy Statement.  

Important note for School Services: When we provide services to a school district, school, or other educational agency (each, a “School Partner”), we act as a service provider to the School Partner and may be considered a “school official” under the Family Educational Rights and Privacy Act (“FERPA”) to the extent applicable. In those cases, our handling of education records and student data is governed by our agreements with School Partners and applicable law. Please see our Children’s Privacy Statement for more information. 

1) Scope

This Privacy Policy applies to information collected:

  • through our websites and apps,
  • through our tutoring platform (including audio, video, chat, and learning tools),
  • during onboarding, support, and program operations, and
  • offline where we later associate it with information collected online.

This Privacy Policy does not apply to third-party websites, services, or applications that may be linked from our Services.

2) Key Definitions

  • “Student Data”: information that identifies or is reasonably linked to a student, including data maintained in connection with providing educational services.
  • “Personal Data”: information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with a particular consumer or household (as defined under the California Consumer Privacy Act, as amended by the CPRA; “CPRA”).

3) Information We Collect

A. Information you provide

Depending on how you use the Services, we may collect:

  • Child and Student information as described in our Children’s Privacy Policy
  • Account and contact information: name, email, phone number, username, password, role (parent/guardian, student, tutor, educator/admin)
  • Student information (for tutoring and program delivery): student name, grade (as applicable), school (as applicable), teacher (as applicable), learning goals, scheduling preferences, accessibility needs, and any other voluntarily provided information
  • Tutoring content: session audio recordings, messages, assignments, files, whiteboard work, notes, and other content submitted during sessions (“Session Content”)
  • Payment information (Direct Services): billing address, payment method details (processed by payment processors; we typically do not store full card numbers)
  • Support communications: information you share when contacting us (e.g., emails, chat messages, support tickets, call notes)
  • Optional information: surveys, feedback, testimonials (with permission), and preferences

B. Information we collect automatically

We may collect:

  • Device and usage information: IP address, device identifiers, browser type, operating system, app version, time zone, pages/screens viewed, actions taken, referring/exit pages, and performance data.
  • Cookies and similar technologies: see Section 7.
  • Approximate location: derived from IP address (e.g., city/state). We do not require precise geolocation to use our Services.

4) How We Use Information

We use information to:

  • Provide and operate the Services (create accounts, schedule sessions, deliver tutoring, and provide learning tools).
  • Support learning outcomes (match tutors, personalize instruction, track progress, and provide reporting to authorized users).
  • Communicate (service announcements, scheduling notices, support responses; marketing communications for Direct Services where permitted).
  • Program administration (attendance, session minutes, compliance reporting, quality assurance, tutor training, and coaching).
  • Safety, security, and integrity (fraud prevention, abuse detection, investigations, enforcing policies, protecting users).
  • Improve and develop Services (debugging, performance, feature development, and analytics).
  • Meet legal obligations (tax, accounting, compliance, lawful requests).

5) Children’s Privacy (COPPA)

Air Tutors offers tutoring for children and teens, including users under 13. Our Children’s Privacy Statement applies to personal data collected from users under 13 years of age of Air Tutors and individuals enrolled at a primary, secondary, or other educational institution (the “School Partner”) who use our products offered in a K-12 education setting with School Partners (“School Services”). If there is a conflict between our Children’s Privacy Statement and our Privacy Policy, the Children’s Privacy Statement sets the standard for how we process children’s personal data.

6) Cookies, Analytics, and Advertising

A. Cookies and similar technologies

We use cookies and similar technologies for:

  • Authentication and security,
  • Preferences and settings,
  • Basic analytics and performance,
  • Feature functionality

B.Analytics

We may use analytics providers to understand usage and improve Services. Where feasible, we configure analytics to minimize collection and avoid advertising use cases.

C. Advertising (Direct Services)

For Direct Services marketing, we may use advertising tools that measure ad performance and help reach interested families.  

We do not knowingly engage in targeted advertising based on Student Data from School Services.

D. Global Privacy Control (GPC)

Where required, we treat browser-based signals such as Global Privacy Control as a request to opt out of “sale”/“sharing” of personal data as defined by CPRA for the applicable browser/device, to the extent we engage in such activity.

7) Session Recording

Air Tutors records audio and produces transcriptions of live tutoring sessions for purposes that may include instructional quality assurance, tutor training and coaching, safety, compliance with School Partner requirements, dispute resolution, and service improvement.

We do not sell or license session recordings or use them for advertising. 

Access and controls
Access to session recordings is restricted to authorized Air Tutors personnel and, where applicable, authorized School Partner personnel, consistent with contractual obligations and applicable law. 

Retention
Session recordings are retained only for as long as reasonably necessary to fulfill the purposes for which it was collected, as required by written School Partner agreements, or as otherwise required to fulfill our legal obligations. After the applicable retention period, recordings are permanently deleted or de-identified in accordance with our documented data retention schedule.

8) How We Share Information

We may share information as follows:

  • With service providers: We share information with vendors that help us operate the Services (e.g., hosting, communications, analytics, security, customer support, payment processing). Vendors are contractually restricted to use information only to provide services to us and must protect it.
  • With parents/guardians and authorized users: Depending on settings and program configuration, we may share progress updates, attendance, and tutoring summaries with parents/guardians and authorized educators/admins.
  • Legal and safety: We may disclose information to comply with law, respond to lawful requests, protect rights and safety, investigate fraud/abuse, or enforce agreements.
  • Business transfers: If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of the transaction, subject to standard protections.

We do not sell Student Data. We do not disclose Student Data for behavioral advertising.

Service Providers

We use trusted service providers to support the operation of our Services:

Video and communications: We use Amazon Chime, a service provided by Amazon Web Services, to enable live tutoring sessions. Session audio and video are transmitted and stored in accordance with our contractual arrangements and security practices.
Payment processing: We use Stripe to process payments for Direct Services. Payment information is collected and processed directly by Stripe in accordance with its privacy and security practices. Air Tutors does not store full credit card numbers.

These service providers are contractually required to protect information, use it only to provide services to us, and comply with applicable privacy and security obligations.

9) Data Retention

We retain personal data only as long as reasonably necessary to:

  • provide, maintain, and improve the Services,
  • meet contractual requirements with School Partners,
  • comply with legal obligations,
  • resolve disputes, enforce agreements, and
  • maintain security and integrity.

Retention periods may vary by data type and program. We maintain limited backups for security and disaster recovery and delete or de-identify data from backups according to our retention schedules.

10) Security

We use reasonable administrative, technical, and physical safeguards designed to protect information. Our infrastructure relies on reputable cloud service providers and industry-standard security controls designed to protect the confidentiality and integrity of stored and transmitted data. No system is completely secure. We cannot guarantee absolute security, but we work to protect information using commercially reasonable measures appropriate for the sensitivity of the data.

11) Your Choices

A. Account information

You may review and update certain account information through your account settings or by contacting us.

B. Marketing communications (Direct Services)

You can opt out of marketing emails by using the unsubscribe link in our messages. You may still receive non-marketing service communications (e.g., scheduling, billing, security notices).

C. Cookies

You can control cookies through browser settings and, where available, cookie preference tools.

13) International Users

Our Services are operated from the United States. If you access the Services from outside the U.S., you understand that information may be processed and stored in the U.S. and other jurisdictions where our service providers operate.

14) Changes to this Privacy Policy

We may update this Privacy Policy periodically. If changes are material, we will provide notice by posting an updated version and updating the “Last Updated” date, and where appropriate, by additional notice (e.g., email or in-app message).
